A class action lawsuit is pending in the Superior Court of Arizona, Maricopa County entitled In re Swift Transportation Co. Inc., CV2004-001777.
If you drove a truck for Swift Transportation Co. after March 6, 2001, as an owner-operator, or after April 9, 2009, as an employee, a class action lawsuit may affect your rights.
The Court has not decided whether Swift did anything wrong. There is no money available now and no guarantee there will be. Your legal rights are affected by this class action. You have a choice to make.
Mr. Garza and his attorneys must prove the claims against Swift. If money or benefits are obtained from Swift, and you do not exclude yourself from the class, you will be notified about how to obtain a share.
Currently there is no settlement or award and if one is obtained you will be notified.
UPDATE AS OF JANUARY 2017: On January 10, 2017, the Arizona Supreme Court denied review of the Arizona Court of Appeals reversal of Judge Gama’s July 13, 2015 order decertifying the class. In light of this victory for our class of drivers, we will be looking to schedule trial as soon as possible. We will continue to update you and other drivers as more information becomes available.
